Terms of Service

1. Who you're contracting with

These Terms of Service govern your use of this website, operated under the trading name HGC (Individual/Sole Trader), ABN 83 884 752 436, registered in WA, Australia. By creating an account or using this site, you agree to be bound by these Terms. If you don't agree, please don't use the site.

2. Eligibility and your account

You must be at least 18 years old to create an account, and you confirm this when you sign up. You must also confirm at signup that you understand physical items can only be shipped to addresses within Australia.

You're responsible for keeping your login details secure and for activity that happens under your account. Tell us straight away if you think someone else has accessed it. Accounts are for personal, non-commercial use, and each person may hold one account.

3. Buying packs

All prices are shown in Australian dollars (AUD) and are the total amount you pay — nothing is added at checkout. Payment is processed securely by Stripe; HGC never sees or stores your card number. A contract is formed when your payment is confirmed. We may refuse or cancel an order — for example if there's a pricing error, the pack is out of stock, or we suspect fraud — in which case we'll refund you in full.

HGC is not currently registered for GST, so no GST is included in or added to the prices shown.

4. How mystery packs work

Each pack contains one randomly selected digital card from that pack's published pool. Every pack page shows the exact drop rate for each rarity tier before you buy, based on live inventory — nothing about the odds is hidden or changes retroactively after you've bought a pack. Every purchase results in a real card being added to your collection; there is no outcome where you receive nothing.

The card assigned to your pack is fixed by our server at the moment your payment is confirmed, and simply revealed to you when you open it. That server-recorded outcome is authoritative and final — the reveal animation and on-screen presentation are for effect only and don't determine the result.

Prizes are genuine, factory-sealed Pokémon Trading Card Game booster packs, sourced through normal retail channels — not reproductions, and not opened or resealed by us.

Digital cards in your collection have no cash value. They cannot be redeemed, resold, or exchanged for money through HGC, and HGC does not operate a marketplace, buyback, or store-credit system for them. You may separately choose to have specific cards from your collection shipped to you as physical items, for an additional shipping fee.

5. Product names and trademarks

Products available through mystery packs are genuine Pokémon Trading Card Game products, manufactured by their respective rights holders and sold by us as an independent retailer. Pokémon and all related names, characters, and images are trademarks of Nintendo, Creatures Inc., and GAME FREAK inc. HGC is not affiliated with, endorsed by, or sponsored by the Pokémon Company or its affiliates — we sell genuine third-party product, and we use these names only to accurately describe what you're buying.

6. Shipping

Physical items can only be shipped to addresses within Australia. See our Shipping & Returns policy for delivery estimates, shipping cost, and what happens if something arrives damaged.

7. Returns and refunds

We don't offer a refund or exchange simply because you didn't receive the card you were hoping for — the odds for every pack are published up front, and the server-recorded outcome described in section 4 is final. Nothing in these Terms limits or excludes any right or remedy you have under the Australian Consumer Law, including guarantees that goods are of acceptable quality and fit for purpose. Where the law gives you a right to a repair, replacement, refund, or compensation — for example if a payment fails, a parcel is lost, or an item arrives damaged — that right applies regardless of anything else in this document. 8. Prohibited conduct

You must not:

• use the site for any unlawful purpose, including fraud or money laundering;
• create or use more than one account to work around a restriction placed on your account;
• attempt to gain unauthorised access to our systems or other users' accounts;
• use bots, scrapers, or other automated means to access the site without our permission; or
• attempt to manipulate or interfere with the random draw used to determine pack outcomes.

We may cancel transactions, suspend or terminate accounts, and report conduct to relevant authorities where appropriate.

9. Intellectual property

The site and its content — including text, graphics, logos, and software — are owned by or licensed to HGC and protected by Australian intellectual property law. You may not copy, modify, or reproduce any part of the site without our permission.

10. Disclaimers

The site is provided "as is". To the extent the law allows, we don't warrant that the site will be uninterrupted or error-free. Card values, where referenced, are indicative only and not investment advice.

11. Liability

To the extent the law allows, HGC's liability to you is limited to resupplying the affected product or service, or refunding what you paid for it. This doesn't affect any guarantee that can't be excluded under the Australian Consumer Law, and doesn't limit liability for death or personal injury caused by our negligence, or for fraud.

12. Privacy

Our collection and use of your personal information is described in our Privacy Policy, which forms part of these Terms.

13. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account for a breach of these Terms, suspected fraud, or other legitimate reason — where reasonably practicable we'll notify you first.

14. Governing law

These Terms are governed by the laws of WA, Australia, and you submit to the non-exclusive jurisdiction of its courts. If you have a dispute with us, please contact us first — we'll try to sort it out in good faith.

15. Changes to these Terms

We may update these Terms from time to time; the "Last updated" date above will change. For anything material, we'll try to give reasonable notice. Continuing to use the site after a change means you accept the update.
